Além de Deuteronômio 24.1-4, há diversos textos relevantes a respeito do divórcio e novo casamento no AT. O casamento consistia de um contrato que estipulava as obrigações a serem cumpridas de ambas as partes e as sanções a serem aplicadas caso a mulher fosse divorciada. De forma geral, o divórcio no AT é permitido (Dt 24), mas há ocasiões em que ele é proibido (Dt 22); às vezes é ordenado por Deus (Êx 21; Dt 21; Ed 10; Ne 13); condenado por ele (Ml 2) e há situações em que o próprio Deus está envolvido no divórcio de seu povo (Oseias; Jr 3; Is 50). Embora o divórcio não faça parte da intenção original de Deus (Deus odeia o divórcio), este pode ser o mal menor em algumas situações, sempre visando à proteção da parte mais fraca no relacionamento: a mulher divorciada.
